Terms of Service

These Terms of Service ("Terms") govern your use of Checkeroni, an uptime monitoring service operated by vblinden ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.
The Service
Checkeroni lets you configure monitors for websites and services, run scheduled availability checks, receive alerts, review incident history, and publish optional public status pages. Features may change over time as we improve the product. Free and paid plans may offer different limits (for example monitor count, check intervals, notification channels, and custom domains).
Accounts
You are responsible for maintaining the security of your account and for all activity that occurs under it. You must provide accurate account information and promptly update it if it changes. You may use teams and invitations to collaborate with others, and you are responsible for managing access within your teams.
Acceptable use
You agree to use the Service in compliance with our Acceptable Use Policy and applicable law. You may only monitor systems you own or have permission to test.
Plans, fees, and billing
We offer a free plan and one or more paid plans. Current plan features and list prices are described on our website and in account billing settings. We may change plan features or pricing prospectively; material changes to paid pricing will not retroactively change a billing period already paid unless required by law.
Paid subscriptions are processed by Creem as Merchant of Record. When you purchase or renew a paid plan:
- Creem is the seller of record for the payment transaction, handles payment processing, and may collect and remit applicable taxes.
- Your payment method is charged according to the plan and interval you select (for example monthly).
- Subscriptions renew automatically until you cancel, unless stated otherwise at checkout.
- Creem's Buyer Terms of Service apply to the purchase transaction in addition to these Terms.
Failure to pay may result in suspension or loss of paid features. Free-plan limits may apply if a subscription ends or payment fails.
Cancellation and refunds
You may cancel a paid subscription at any time through the billing portal linked from your account or by contacting us. Cancellation stops future renewals; access to paid features generally continues until the end of the current paid period.
Refund eligibility is described in our Refund Policy. Where mandatory consumer law provides stronger rights, those rights apply.
Availability and support
We aim to keep Checkeroni reliable, but the Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted operation, and scheduled or emergency maintenance may occur from time to time. Uptime monitoring cannot guarantee that third-party systems you monitor will be available.

Your content and monitoring targets
You retain ownership of content you submit (such as monitor targets, status page text, and notification configuration). You grant us a limited license to host and process that content solely to operate the Service. You represent that you have the rights needed to monitor the targets you configure and to publish any public status pages you enable.
Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, create risk for the Service or other users, or if required by law. Upon termination, your right to use the Service ends, though some provisions of these Terms will survive (including disclaimers, limitations of liability, and accrued payment obligations).
Disclaimer of warranties
To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of (a) the amounts you paid us (or Creem for Checkeroni access) in the three months before the claim, or (b) fifty US dollars (or equivalent), except where liability cannot be limited by law.
Privacy
Our collection and use of personal data is described in the Privacy Policy.
Changes
We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms. For material changes that affect paid subscribers, we will take reasonable steps to provide notice (for example via email or an in-product notice) when practical.
